However, recent public records requests directed at the national trading standards, Environment Agency, and Office for Product Safety and Standards reveal that there have been very few penalties or prosecutions, leaving illegal operators with little incentive to comply with the law.

“This is why we are calling for the establishment of a licensing system for e-cigarette retailers and distributors. Retailers who obtain a license must demonstrate that they have taken steps to prevent the sale of e-cigarettes to minors, while distributors must ensure compliance with environmental regulations and only sell products that have passed compliance checks.”
Dunne also urged that retailers and distributors who violate the law should face fines of up to £10,000 and £100,000, respectively. He emphasized that the licensing system is expected to generate approximately £50 million in funding for necessary enforcement efforts.
