UKVIA Calls for Licensing System to Protect E-Cigarette Retail and Youth Amid New Legislation in October 2024

UK’s Disposable E-garette Ban

On October 24, 2024, the UK government announced that it would ban disposable e-cigarettes starting next June. This measure has sparked widespread attention, with UKVIA pointing out in a statement that e-cigarettes and disposable e-cigarettes have played a crucial role in reducing smoking rates, bringing adult smoking prevalence to historic lows.

“While there are some controversies surrounding disposable e-cigarettes, their convenience and accessibility—especially among low-income groups who are often the primary smokers—cannot be denied,” said John Dunne, UKVIA’s Director General. “We must proceed with caution in future legislation to ensure we do not punish those adults wishing to quit smoking through vaping, as there is already evidence that e-cigarettes are the most effective method for cessation.”

Dunne also mentioned, “We do not shy away from addressing the environmental impacts of disposable e-cigarettes and the challenges posed by youth vaping; these issues need to be confronted directly.” He added that the ban does not prevent the importation of disposable e-cigarettes, meaning that a significant volume of e-cigarettes will still enter the UK market, potentially fueling the growth of the black market.

“We have seen in other regions, such as Australia, that bans do not solve the problem; instead, they may encourage the black market, posing greater risks to young people and the environment.”

Enforcement and Compliance Measures

Dunne stated that what is truly needed is stricter enforcement of existing laws, including regulations that prohibit the sale of e-cigarettes to individuals under 18, as well as compliance with environmental laws related to waste and electrical equipment. However, recent public records requests directed at the national trading standards, Environment Agency, and Office for Product Safety and Standards reveal that there have been very few penalties or prosecutions, leaving illegal operators with little incentive to comply with the law.

Advocating for Retailer and Distributor Licensing System

“This is why we are calling for the establishment of a licensing system for e-cigarette retailers and distributors. Retailers who obtain a license must demonstrate that they have taken steps to prevent the sale of e-cigarettes to minors, while distributors must ensure compliance with environmental regulations and only sell products that have passed compliance checks.”

Dunne also urged that retailers and distributors who violate the law should face fines of up to £10,000 and £100,000, respectively. He emphasized that the licensing system is expected to generate approximately £50 million in funding for necessary enforcement efforts.
